The Angel Flight charity is in shock after a plane crash in western Victoria that killed
the volunteer pilot and a 15-year-old girl returning home from a medical appointment.

Angel Flight founder and chief executive BILL BRINSTOW says 69-year-old DON KERNOT
was an experienced pilot who'd been involved in 24 missions for the charity.

He'd bought the plane especially to help people in need, like 15-year-old JACINDA TWIGG
who was returning to her Nhill home from a medical appointment in Melbourne.

Her mother survived the crash in a paddock near Horsham last night, but remains in
a critical condition in Royal Melbourne Hospital.

KEVIN RUDD says Labor will commit 160 million dollars .. to help fund a desalination
plant on South Australia's Spencer Gulf.

The opposition leader's described the proposed plant as an important project .. and
a practical step to water shortages in the region.

The plant is to be built by BHP Billiton .. primarily to service the expansion of the
company's Olympic Dam uranium mine in the state's far north.

But it'll also supply fresh water to the South Australia's upper Spencer Gulf and the
Eyre Peninsula .. including the major regional towns of Port Augusta and Whyalla.

About 22 gigalitres of water .. or one third of the plant's annual capacity .. will
be diverted for domestic use .. reducing demand for water currently pumped from the Murray.

Mr RUDD says Labor's commitment will match the 160 million dollars already promised
by the South Australian government.

The federal opposition says families will sleep easier knowing the generous childcare
rebate won't be targeted in the May budget.

Federal Treasurer WAYNE SWAN has reportedly ruled out a Treasury proposal to means-test
the rebate .. capped at seven thousand 500 dollars a year .. to help deliver budget savings.

News Limited reports Mr SWAN decided against the politically risky move .. following
a marathon session with his budget razor-gang yesterday.

The coalition's childcare spokeswoman SUSSAN LEY has welcomed the apparent back-flip
.. describing the proposal to cut the rebate as a ham-fisted cash grab.

A Melbourne court has told the 11 men who have pleaded guilty to charges over a riot
outside a Bob Jane T-marts store after the cancellation of a legal drag race .. thought
the rampage was funny.

The men .. some through their lawyers .. have pleaded guilty to a charge of riot over
the trashing of the Oakleigh store on March 19 last year.

Some are charged with additional offences .. including theft and burglary.

Five of the men had their matters adjourned for a pre-sentence hearing in March ..

while the rest will have their individual cases heard this week.

Prosecutor DIANA KARAMICOV told the Melbourne Magistrates' Court .. word spread about
the protest against the cancellation of the Easternats event .. sponsored by Bob Jane
.. via text message and the internet .. and a peaceful demonstration turned ugly once
the crowd swelled to about two-thousand people.

The pre-sentence hearing before Magistrate Andrew Capell continues and is due to conclude
on Friday.

The Cancer Council says the Rudd government must increase tobacco taxes if it's serious
about preventative reforms in health care.

He says he's hopeful media speculation about a significant increase in the tobacco
taxes will become reality in next month's federal budget.

8TV's One in a Million reality star IZ recently shot two music videos featuring well-known Malaysian celebrities for his song Gonna Be Alright, off his debut EP.

He did so in conjunction with the 1Malaysia campaign championed by the Malaysian government and to also commemorate the recent 52nd Merdeka celebration last month.
The music video features Dynas Mokhtar (actress/ model), Amber Chia (model/spokesperson), Soo Wincci (Miss World Malaysia 2008/ 2009), Isma Yusoof (actor/director), Ben Ibrahim (host), C. Loco (rapper/ songwriter) and Suki (singer).

The two videos, which were shot in English and Mandarin, will make their debut on RTM Muzik Aktif (Astro channel 180), RTM1 and RTM2 next month.

Gonna Be Alright is a reflection of his character as someone who does not succumb setbacks. IZ hopes it will inspire others to not wallow in failures and disappointments in life but use them as lessons to do better in the future.

On the 1Malaysia campaign, IZ feels that it is important for new artistes to support the campaign.

"I strongly feel that music is the best mediator in getting the spirit of 1Malaysia across to the young generation, who inevitably are our future leaders. I hope to see that one day our country will achieve true `oneness' where we do not define and divide ourselves as Malay, Chinese, Indian or others, but as proud Malaysians."

After seeing both versions of IZ's 1Malaysia-inspired music videos, Datuk Mahadzir Lokman feels that the Mandarin version is a great rendition by the young singer.

"IZ's rendition of Gonna Be Alright truly inspires me, a Malay artiste singing the song in Mandarin. Kudos to the young up-and- coming star who's not afraid to transcend boundaries, and to promote the spirit of 1Malaysia."

IZ was recently appointed as the exclusive icon for the Science, Technology and Innovation Ministry's latest nationwide Cyber Security & Internet Safety Awareness campaign for the young. He is also currently busy working on new materials for his full studio album.

He will be launching his latest single called A.L.O.N.E, a result of his collaboration with AJ Pop Shuvit and will soon announce his involvement with an international project in 2010.

A study shows a third of all Australians with type 1 diabetes were initially misdiagnosed
as having the more common type 2 or some other illness .. and its a mistake that can be
deadly.

People with the rarer form of diabetes produce no insulin at all .. meaning they need
daily injections and not the less intensive treatments for those with diabetes type 2.

KATE GILBERT .. president of The Type 1 Diabetes Network .. says it's a 24 to 48 hour
process where the body can operate with no insulin before you go into a coma and die.

The support group conducted a poll of more than 850 Australians with type 1 diabetes
.. and found a third were misdiagnosed.

One in ten reported having a blackout before they were correctly diagnosed .. while
five per cent fell into a diabetic coma.

Of those who were misdiagnosed .. 65 per cent had to go back to their healthcare professional
three or more times before this was corrected.

Fed: Govt backflips on means test for solar rebate

CANBERRA, Dec 17 AAP - All households will be able to get half-price solar panels after
the federal government abandoned its unpopular decision to means-test its solar rebate.

The government will scrap the means test, meaning all Australian homes will qualify
for a rebate worth up to $7,500.

The new rules mean any household can install a good-sized solar system and be as little
as $7,500 out of pocket.

When this year's budget restricted the solar rebate to households earning less than
$100,000, critics said it was a step backwards as climate change worsened.

In a surprise backflip on Wednesday, Environment Minister Peter Garrett announced the
test would go.

"(The rebate) will be open to everybody and it will apply to households, small businesses
and community groups," Mr Garrett said.

Under the new scheme, the government will not have to fund the rebate, with the cost
shifted to electricity companies.

Electricity companies will fund the rebate in return for higher credits from the government
under its Renewable Energy Target (RET) scheme.

The RET scheme will help Australia achieve its target of drawing 20 per cent of the
nation's electricity needs from renewable sources by 2020.

In return for passing the rebate burden on to power companies, the government has promised
them five times as many credits, compared with other renewable power sources, under the
RET scheme.

But there are concerns that the government's strategy to heavily favour solar power
with a generous credit regime will hurt other renewable sources such as wind.

Matthew Warren, chief executive of the Clean Energy Council, was pleased the means
test had been scrapped but reserved his judgment in general.

"We've got a number of concerns ... (the domestic solar industry) is being treated
like a hobby by government, an industry that they indulge," Mr Warren told AAP.

Greens senator Christine Milne said giving bonus credits to solar power undermined
the RET scheme.

She also said she was not happy that the solar rebate would be scaled back from 2012
and dumped in 2015-16.

Opposition environment spokesman Greg Hunt said it was an embarrassing backdown for
the environment minister.

"The apparent removal of the means test is a humiliating capitulation for Mr Garrett,"

Mr Hunt said.

CANBERRA, April 3 AAP - The company pushing a proposed Melbourne to Brisbane inland
railway has submitted a business case to the NSW and Queensland state governments for
a $900 million, 350 kilometre section of the link.

Australian Transport and Energy Corridor (ATEC) has asked premiers Morris Iemma (NSW)
and Anna Bligh (Qld) for an "unconditional exclusive mandate" to build a border railway
between Moree and Toowoomba.

ATEC says the link will cost $900 million and be built by 2014.

ATEC chairman Everald Crompton said the border railway would be built by a consortium
of rail, infrastructure and superannuation companies, many of whom "have already expressed
genuine interest in this substantial project".

The federal government last week announced a $15 million feasibility study into the
proposed Melbourne to Brisbane railway.

It is expected the $3.1 billion railway would take freight off the roads and slash
rail freight travel time between the two cities from 36 hours to 21 hours, making it competitive
with road transport.

The proposed inland rail link would pass through central-western NSW, bypassing Sydney.

Federal Transport and Infrastructure Minister Anthony Albanese says the feasibility
study, to be conducted by the Australian Rail Track Corporation, will help the government
evaluate whether the project is viable.

The Melbourne-Brisbane railway was first mooted under the former Howard government.

BRISBANE, April 18 AAP - The Queensland government has written to federal Attorney-General
Philip Ruddock asking him to overturn a decision not to charge the airline behind one
of Australia's worst aviation disasters.

No charges can be laid against Transair over the 2005 Lockhart River air disaster,
which killed 15 people, because it is too late to take legal action.

A 12-month statute of limitations means the Commonwealth Director of Public Prosecutions
cannot take action against Transair.

That is despite the Australian Transport Safety Bureau (ATSB) earlier this month finding
a careless pilot and poor maintenance were the chief reasons behind the crash.

Mr Beattie told the Queensland parliament today the families of those killed "deserved
better and they deserve justice".

"Despite the ATSB investigation finding that Transair failed to report 25 safety incidents
in the two years leading up to the crash, and pilot error and poor maintenance to blame
for this tragedy, no action will be taken against the airline due to a 12-month statute
of limitations that's expired," Mr Beattie said.

"I understand the statute of limitations ... I think that's not a bad principle - but
(only) 12 months?"

He said Queensland's Attorney-General Kerry Shine had yesterday written to Mr Ruddock
questioning how the decision was allowed to occur and what could be done to overturn it.

"The investigation has taken so long, so how can you possibly have a 12-month statute
of limitations?" Mr Beattie said.

"The federal government should address this issue immediately.

"To not do so will compound the injustice to the families of the Lockhart River crash."

Everyone aboard the Transair Metroliner died when it crashed and exploded in flames
near the Lockhart River Aboriginal community in Cape York, in far north Queensland.

Firefighters are battling to contain parts of a large bushfire in central NSW .. before
a forecast drop in humidity feeds the flames later today.

Authorities say the Goldmine Road fire .. 45 kilometres south-west of Narrabri .. is
burning on two fronts and has scorched over 12 and a half thousand hectares.

But the Rural Fire Service's REBEL TALBERT says it's not threatening any property.

Milder conditions overnight allowed vital backburning .. and firefighters hope to bring
the blaze under control later in the week.





The Goldmine Road bushfire and six other contained blazes have been burning for weeks
around Coonabarabran and Narrabri .. blackening more than 130 thousand hectares.

Meanwhile in the state's south .. about 100 firefighters and seven aircraft are mopping
up a blaze that's given the township of Tumut near the NSW Snowy Mountains .. a scare.

Almost 12 thousand hectares of bushland and pine plantation have been razed by the
fire burning close to the Goobragandra Valley.

Heres a question. Have you ever surfed the Web and the Net, clicked on a Web site that turned out to be sexually explicit? Well, Congress is trying to help you avoid that.

Its considering legislation that would require commercial Web sites containing sexually explicit material to carry a warning label. That could make it easier for filtering software to block those pages. The bill could also force non- pornographic sites to make a tough choice adopt a label, or risk a prison sentence.

A number of studies indicate that young people frequently stumble across unwanted pornography on the Internet, graphic sexual images that they are not looking for. Montana Senator Conrad Burns says thats why hes attached this language to legislation moving through Congress.

Senator CONRAD BURNS (Republican, Montana): IT requires, if you have sexually explicit material in your Web site, one way or the other, you have to put that on your homepage.

ABRAMSON: That warning label could come in the form of invisible meta text, data that tells filtering software this really is porn. The goal, according to Rachel Brand of the Justice Department, is to give parents more control.

Ms. RACHEL BRAND (United States Justice Department): The point is to allow parents to protect their children from exposure to pornography if they wish, without prohibiting any content from being posted on the Internet. So this proposal wouldnt affect the substance or the appearance of any Web site, but for anyone who chooses to use a filter on his or her computer, it would help ensure that the filters pick up pornographic sites.

ABRAMSON: Note that supporters say theyre not trying to keep anything off the Internet. Nine years ago, the Supreme Court struck down a law intended to block salacious material from the Web. Congress tried again with the Child Online Protection Act, which wouldve made racy content available only to those who could prove they were adults. That law was challenged and is still in litigation.

Civil liberties groups blocked both of those laws from taking effect, and Leslie Harris, of the Center for Democracy and Technology says shell fight this latest attempt as well.

Ms. LESLIE HARRIS (Center for Democracy and Technology): This is a label that would require everything from an artist selling online, to Victorias Secret, to, you know, the most hard-core pornography, all to carry the same label.

ABRAMSON: Opponents of those earlier laws said that Internet filtering software would protect users from unwanted porn. They argued that strict prohibitions on graphic online content were unconstitutional.

Now the government wants to give a boost to the filtering approach, but Leslie Harris says the governments experiment with mandatory filtering for TV viewers should serve as a caution.

Ms. HARRIS: This reminds me of the V-Chip, where we passed a law about exactly what the technology would be and exactly how we would address blocking content in the television context. And there has been no innovation in that space since.

ABRAMSON: Harris says this new requirement would create a terrible dilemma for safe sex sites, or for those that offer material posted by other people, such as social networking sites or auction sites. They would have to decide whether to carry a warning label or face potential criminal penalties the law would set down.

Senator Conrad Burns has some advice for those sites.

Sen. BURNS: Well, I would say that you better watch what you put on your Web site, what you advertise.

ABRAMSON: A 2003 law requiring labeling of explicit commercial e-mail messages has led to numerous fines and suits against spammers. But applying that standard to the World Wide Web will revive the debate over censorship online.

Charys Holding Company announced the successful closing of a new $5 million asset based credit facility with CAPCO Financial Company, a division of Palo Alto, California based Greater Bay Bank N. A., through its financial advisor and placement agent Kaufman Bros., L.P.
The completion of the credit facility restructures debt of its wholly owned subsidiary CCI Telecom, Inc. (CCI) acquired on March 4, 2005. The facility is secured by a first lien position on the assets of CCI. Additionally, Charys issued the lender a warrant to purchase up to 830,000 shares of Charys common stock over a seven-year period. The initial drawdown of the facility was approximately $2.6 million, of which $2.5 million, combined with a $300,000 unsecured note and the issuance of 500,000 shares of Charys series C Convertible Preferred Stock, was used to pay-off the existing line of credit, which as of the closing date had an outstanding balance of $4.55 million.

Vic: Teenager attacked leaving McDonalds

Police are appealing for help with an investigation into an attack on a teenager in
Melbourne's south east on Saturday.

Police say a 19-year-old Seaford man was leaving a McDonalds store in nearby Cheltenham
about 11.45pm (AEDT) and was attacked at the bottom of a walkway by a man who punched
and kicked him in the head.

The injured man was taken to Monash Medical Centre with serious head injuries.

Police are seeking a gold, early model 1970s or 1980s Ford Fairlane sedan in which
it's believed there were five people.

When it comes to cybersecurity, the 'who is responsible for what?' debate continues.(Homeland Security News)

Most experts seem to agree that the U.S. government's collective efforts to secure the Internet from large-scale attacks and other nefarious activities are lacking. As for who is responsible for protecting this vital piece of infrastructure, the debate inside and outside the government is ongoing.

Gcnerally, the Defense Department is responsible for its own networks, and the Departments of Homeland Security and Justice for the remainder of the nation. The FBI has the duty to investigate Internet-based crimes, espionage and attacks. DHS has made the Internet part of its critical infrastructure protection programs, but it has no regulatory authority to make an electric company, for example, update its computer security protocols.

The U.S. government is serious when it comes to developing its cyber-offense capabilities, "but is lackadaisical" when it comes to defense, said Michael Peters, a former National Security Agency employee, who currently serves as chief cybersecurity advisor to the Federal Energy Regulatory Commission.

An example of the federal disconnect is the growing smart grid movement. These new power distribution systems, designed to more efficiently move electricity to where customers need it most, are being promoted by the Obama administration with stimulus money, but there are no security requirements attached to the Department of Energy grants to ensure that utility companies are building security measures into the systems from the ground up.

"Smart grids are not so smart," said Stewart Baker; a visiting fellow at the Center for Strategic and International Studies, and co-author of a report sponsored by Internet security provider, McAfee, "In the Dark: Critical Industries Confront Cyberattacks."

He likened it to the very beginning of the Internet itself; when security measures were not built into the system. This is exactly what is happening with smart grids today, which rely on the Internet for command and control.

Should the government force critical infrastructure in private sector hands to comply with computer security requirements? The report showed that in countries such as Japan and China--where government auditors make sure that companies comply with computer network requirements--there is significantly better security, Baker noted during a panel discussion held in Washington, D.C.

On May 12, President Obama revealed a set of legislative proposals that would make critical infrastructure operators in the private sector list their threats and vulnerabilities, and then address them with a risk mitigation plan, A third-party auditor would then assess the plan.

Kevin Gronberg, senior counsel on cyber-security matters to the House Homeland Security Committee, said prior to the president's speech that he was skeptical that legislation would do more than catch the "low hanging fruit." Forcing companies to "check the box" on certain security requirements may not be effective, he added.

"A compliance regime is extremely important but is unfortunately not the be all and end all" solution, he said. Federal agencies that are 100 percent compliant with network security rules have still suffered massive data losses from hackers, he said.

The Homeland Security committee is in the early stages of writing legislation, he said, but noted that, like the executive branch, there are a lot of players in the cybcrsecurity realm. Many committees, especially in the House, claim jurisdiction over the matter. "Ensuring that all those players are up to speed, contributing, and are heard, is going to be a gigantic task in and of itself/' Gronberg said.

And he is concerned that if comprehensive cybersecurity measures were to pass, Congress would walk away from the matter and believe that it had been solved.

Meanwhile, retired Marine Corps Gen. Peter Pace, former chairman of the Joint Chiefs of Staff, would consolidate federal network security efforts under one roof. He recommended handing over the Department of Homeland Security's cybersecurity responsibilities to the head of the newly created U.S. Cyber Command.

"The number of 10-pound brains in any nation is limited," he said, referring to the difficulties the government has had in hiring cyber-experts. Speaking at a cybersecurity conference in Colorado Springs, Colo., Pace said the United States does not need to "replicate" the National Security Agency.

Army Gen. Keith Alexander wears two hats, one as commander of U.S. Cyber Command under the secretary of defense and the second as the director of the NS A, under the director of national intelligence. He should wear a third hat and answer to the DHS secretary. Pace said.

There would be privacy concerns and misgivings about the U.S. military working in the domestic realm, but "it needs to be done," Pace said.

Both the NSA and Cyber Command are located at Fort Meade, Md. The NSA specializes in Cryptology and eavesdropping but is also responsible for protecting US government communication systems.

On the investigative side, evidence of inter-agency turf wars emerged in April with the release of a Justice Department inspector general report, "The Federal Bureau of Investigation's Ability to Address the National Security Cyber Intrusion Threat." It described the FBI's reluctance to share information with other partners on the National Cyber Investigative Joint Task Force, which was specifically organized for that purpose. The redacted report said representatives from non-FBI agencies were routinely asked to leave in the middle of meetings when the FBI didn't want them to hear specific information. In one case, FBI agents refused to share information with the Naval Criminal Investigative Service.

Interested in learning more about arthritis? Wondering where your neighbor can find a support group for the rare disease he was just diagnosed with?

If you have a computer, a modem and access to the internet, the answers are right at your fingertips.

In just a few short years, cyberspace has revolutionized the way consumers find information, help and support. Eventually, predicts Tom Ferguson, M.D., it will revolutionize the health-care system Itself.

A Health-Care Revolution

"We've created a healthcare system in which skills and information are available only to health-care professionals," says Ferguson, author of Health Online (Reading, Mass.: Addison-Wesley, 1996). We're now entering an era in which the information is available to anyone with a computer. The role of the health-care professional as the one who knows it all and does it all in health care will have to change. Computers will allow consumers to manage a great portion of their health affairs, to seek the information they need to make decisions and manage problems with occassional interaction and partnering with clinicians."

Some practitioners already see this change coming. In the past year or so, medical professional publications have been peppered with articles about consumers turning to cyberspace for medical information and support. Some of these articles have a positive spin, quoting doctors who say that patients who seek information on-line are better informed; others have a negative spin, quoting doctors who say their patients are searching for information on-line in an effort to second-guess them. And many point to the fact that while much of the information available on-line is valuable, there is misinformation out there as well. Despite these criticisms, however, all the articles indicate that "cyber, health care is here to stay.

A Valuable Resource

So what actually is out there? And how can consumers tap into this valuable resource? We asked Ferguson and Jeanne C. Ryer, author of Wiley and Sons' soon-to be published Health Net: Your Essential Resource for the Most Up-to-Date Medical Information Online, to give us an overview.

According to Ryer, there are several major sources of consumer information, including consumer-oriented fact sheets on major diseases; databases of medical information, including databases on genetic information, drug references, cancer, rare diseases and the major medical literature; and the contents of the major medical journals themselves -- in both abstract and full-text form.

"But it's more than a giant encyclopedia on steroids," Ferguson says, adding that cyberspace also offers interaction and support. There are hundreds of on-line communities where you can go to not only obtain information, but also to ask questions, exchange advice and experience and even find support. These on-line support and self-help groups have much to offer consumers, especially those suffering from chronic conditions, he says.

"There's a real common bond from the get-go," Ferguson says. "The level may be even more intimate than in real life. In fact, some people say they can talk about things on-line that they can't tell their spouses. Everyone is dealing with the same problem. And you can be anonymous. You don't have to dress up. In fact you don't have to speak at all. You can just read the posting or listen to the chat sessions.

"These communities include a fairly hefty proportion of health professionals as well as self-helpers," Ferguson says. And the selfhelpers themselves are amazingly knowledgeable. "If you're newly diagnosed with a brain tumor and you go into a mailing list, you might get better information than you might get in a doctor's office. If you want to know what is the overall life effect of Prozac, you won't find it in a textbook, but you will find it in a support group of people taking Prozac."

Avoiding the Pitfalls

Both Ferguson and Ryer agree that misinformation can be disseminated on-line, but, they say, a savvy consumer can learn to pick out the wheat from the chaff.

"You can't check your brain at the door when you go into this world," Ferguson says. "Although the discussion groups have a high level of self-monitoring, you have to be selective in deciding what you're going to look for and in what place."

"Do what you always do when looking for health information," Ryer says. "Use your own common sense. If it sounds too good to be true, it probably is. There are no controls on what is put on-line. I suggest that people look at where the information is coming from and consider the source." Ryer also suggests that people take the information they come by on-line back to their doctors. While some doctors might not have the time or might not be welcoming, she says, they might actually learn something.

"It's becoming more and more common for people to come into a clinic and know about studies their doctors have never heard of," Ferguson says. But, Ryer adds, they need to get used to it.

"Physicians need to admit to themselves that they don't have time to read everything." She says that if you don't get a good response when you present your doctor with information, "You either need to retrain him or look elsewhere."

Where to Find information

But you won't generate any reaction from your doctor until you learn how to find the information you want to share with him. Once you've got your computer and modem hooked up and figured out how to access cyberspace, you need to know where to go to find health and medical information. According to Ferguson, there are four major sources: commercial services, on-line mailing lists, internet newsgroups (also known as USENET newsgroups) and the World Wide Web.

The commercial services, such as America On-line, Prodigy, CompuServe and Microsoft Network, offer databases, information, and support forums and discussion groups as well as access to the Internet, including the World Wide Web. Both Ferguson and Ryer say these services offer the easiest way to go on-line and are a great place to start.

Once in the Internet, consumers can sign up for line mailing lists, through which they will receive all the messages sent to people on that list. Mailing lists are a common way for likeminded individuals to connect and communicate about a given subject, Ferguson says.

For more interactive communication, there are Internet, or USENET, newsgroups. These are electronic places where people with similar interests can communicate. Ferguson says there are currently thousands of these discussion groups on the Internet, and many are devoted to medical and health topics.

Finally, there is the World Wide Web. This rapidly growing vehicle is chock-full of information that can be accessed via a search engine such as Yahoo or Altavista. The Web currently offers little in terms of discussion and support groups, but Ferguson says that may change in the future as technology is developed to allow for discussion groups.

It may take some time to completely master the technology of "Netsurfing" to find the exact information you need or the support group that feels right for you, but both Ferguson and Ryer say it can be done.

"You don't have to be a computer geek," Ferguson says, adding that he recently introduced his mother, who is in her 80s, to the Internet. Ryer suggests that consumers unfamiliar with computers and cyberspace seek the advice of computer-savvy friend or family members. These people can help you learn to get around, she says. in addition, a growing number of books, such as those written by Ferguson and Ryer, provide detailed information on how to access the sources available in cyberspace.

A look at some proposals to clean up the mutual fund industry.

FEES AND DISCLOSURE

A bill introduced by Rep. Richard Baker, R-La., would require disclosure in dollars, not just percentages, of investor fees; disclosure of compensation to brokerages for distribution of fund shares; and disclosure of so-called soft-dollar arrangements, in which funds steer transactions to a broker in exchange for research and other services.

Massachusetts Secretary of State William Galvin wants lawmakers to ban soft-dollar arrangements, which critics say increase investors' transaction fees.

A bill by Sens. Peter Fitzgerald, R-Ill., and Daniel Akaka, D-Hawaii, advocates: disclosure of portfolio managers' funds holdings; adding brokerage commissions to expenses; and providing written notice of brokers' compensation for selling funds.

New York Attorney General Eliot Spitzer proposed a measure to ensure mutual funds don't pay higher fees than pension funds for the same services.

DIRECTOR INDEPENDENCE

Baker's bill would mandate that at least two-thirds of fund directors be independent of the adviser, up from 40 percent; the Akaka-Fitzgerald bill puts it at 75 percent. Others have called for as few as one inside director.

Both bills would tighten definitions of independence.

The Senate bill would prevent board chairmen from being connected with advisers.

Former Securities Exchange Commission Chairman Arthur Levitt advocates putting an investor representative in an ombudsman role on fund boards.

OTHER PROPOSALS

To address claims that funds have allowed big investors to make trades after they are priced for the day, the leading mutual fund trade group urged rules that would require most transactions to be submitted earlier.

Fund giant Fidelity Investments and others urged creation of a central clearinghouse with technology to prevent late trading.

Mercer Bullard, founder of the Fund Democracy shareholder advocacy group, advocated creation of an independent oversight board. The Akaka-Fitzgerald bill would require the SEC to study the idea.

Fitzgerald said the answer may lie within the SEC. "Not enough attention has been paid to the industry until now," he said. "Now that it's a $7 trillion industry, it merits perhaps a whole separate division within the SEC."
